A courtroom in Maharashtra’s Thane district has acquitted two individuals accused in a case of rape of a girl and forcing her for an abortion, whereas giving them the profit of doubt.

Thane Sessions Judge Dr Rachna R Tehra, in the order pronounced on January 16, mentioned the prosecution didn’t show the costs towards the accused individuals past cheap doubt, therefore they should be acquitted.

The prosecution instructed the courtroom that one of the accused, aged 47, befriended the sufferer in 2009 and raped her on a number of events in Bhiwandi and Kalyan cities underneath the pretext of marrying her.

The accused later bought married, however nonetheless maintained sexual relations with the sufferer, in consequence of which she grew to become pregnant.

The accused then requested the sufferer to abort the foetus. When she refused, he took her to a physician underneath some pretext the place she was compelled to endure the abortion, the prosecution instructed the courtroom.

A 62-year-old man had assisted the principle accused in getting the lady’s abortion carried out, the courtroom was instructed.

The defence counsel contested the case and denied all the costs levied on the accused individuals.

Further, there is no evidence that both the accused threatened the prosecutrix with dire consequence and that the accused in furtherance of their common intention with an accused doctor (who later died) caused miscarriage of the prosecutrix without her consent, it said.

Therefore, the above details show the prosecution failed to bring the accused in the web of the charged offences, the court said.

The doctor accused in the case died during pendency of the trial and hence the case against him was abated.
