Supreme Court Restores 150 MBBS and 49 PG Seats to HIMSR, Orders Jamia Hamdard to Issue Enrolment Numbers to PG Students

New Delhi : The Supreme Court of India has restored 150 MBBS seats and 49 Postgraduate (PG) seats to the Hamdard Institute of Medical Sciences & Research (HIMSR) for the Academic Year 2026–27, bringing clarity after months of uncertainty arising from internal disputes within the Hamdard family.

In its order dated 27 May 2026, the Supreme Court issued the following directions:

  • Restoration of 150 MBBS seats and 49 PG seats to HIMSR for AY 2026–27.
  • National Medical Commission (NMC) has been directed to immediately open its online portal to enable HIMSR to upload its mandatory disclosure report.
  • The Court has granted deemed consent of affiliation to HIMSR for the current academic year, ensuring that the admission process proceeds without administrative obstruction.
  • Jamia Hamdard has been directed to issue enrolment numbers to all 49 PG students admitted pursuant to the Supreme Court’s interim order dated 11 February 2026.

These directions collectively ensure that HIMSR’s academic processes continue without disruption and that students admitted under judicial protection are not prejudiced. Therefore, the Court further directed the Petitioners to maintain a separate account for all fees and financial transactions relating to students admitted for AY 2026–27, and to communicate this account to Jamia Hamdard for audit purposes, ensuring transparency and financial oversight.

A Bench of the Supreme Court directed the National Medical Commission (NMC) to immediately open its online portal to enable HIMSR to upload its mandatory disclosure report, noting that procedural access cannot be withheld when the institution has no academic deficiencies. The Court also granted deemed consent of affiliation to HIMSR for the current academic year to ensure that the admission process proceeds without disruption.

In a significant student-centric direction, the Court ordered Jamia Hamdard to issue enrolment numbers to all 49 PG students admitted pursuant to the Supreme Court’s interim order dated 11 February 2026.

The present order follows earlier interim protections granted on 27 January 2026 and 11 February 2026 in SLP (C) No. 3280 of 2026, where the Court held that students cannot be made collateral victims of internal governance disputes.

The Court also took note of the fact that 150 MBBS seats had lapsed in the 2025–26 academic cycle, not due to any deficiency in HIMSR’s infrastructure or faculty, but due to administrative paralysis arising from internal disputes. The present order seeks to prevent a recurrence of such loss of national medical capacity. The judgment restores academic stability at HIMSR and prevents a repeat of last year’s lapse of 150 MBBS seats.
